OPT RFE - Can I apply for H1B?

I am currently still waiting for my OPT. I applied on 9th Dec. I received RFE on 24th Jan which I have replied to. But still waiting for the result and my OPT card. I have two job offers which are ready to apply for my H1-B visa. Since its already March with H1-B processing going to start in April and finish within a day probably.


1. What if I do not receive my OPT card this month will my company still be able to apply for H1-B on 1st April with my OPT card still pending ?

I think you can go ahead with your H1. It should not be any issue. The main issue here is your graduation done? If not your cant file your H1 in masters quota. Then your employer has to file in regular quota and mention you as a future employee. If you are done with your graduation you can file in masters quota. All the Best

u can file h1b .. if u r opt get declined then u might get 797b instead of 797A( with cos )
