OPT STEM extension is in pending Status, can I apply H1B now?

My OPT has expired earlier this week. I have applied for OPT STEM extension, and USCIS received the application about 20 days before my OPT expiration date. Therefore I'm currently working under the 180 days extended period for extension pending status.

My question is, during the 180 day extension pending, could my employer help me get my H1B petition filed? Would they have to have a valid EAD card to file the petition? or the receipt for my extension from USCIS would be fine? Also, does the "non-profit/cap-exemption" of my employer make a difference here?

2 valid status is fine .. ie receipt ..
3 not all non profits are cap exempt.. if it is cap exempt then you dont have to wait till April r don't need to bother about lottery ..
