  • If OPT gets Denied, after how much time would the SEVIS be completed?

    Hi,

    I want to know after the denial of OPT, how much time would we have until the SEVIS gets completed? And do we have to make a Re-entry?

    What are the options if the OPT gets denied? and how to avoid Re-Entry?

    My OPT I-765 extension case is pending since long time. USCIS received my i-765 (Stem) OPT extension application on May 8th 2013. My first OPT expired on June 25th 2013. I expedited my case twice, and then i received RFE on Nov 26th 2013 to which i responded and USCIS received my documents on Dec 19th 2013. My 180 days (work authorization) from the June 25th have expired on Dec 20th 2013. USCIS told me that the normal RFE processing time would be 60 days. I expedited it on Dec 26th and they told me that they will process it in 30 days but they didn't and then i expedited it again on Jan 27th and now they again told me that they would need 30 more days.

    My question is that, God Forbid in-case if my OPT gets denied, will my SEVIS be completed at that very moment or will USCIS give us some time so that i can take admission into any University and i won't have to do a Re-entry.

    I don't want to do a Re-entry, so what would you suggest?

    Also, i want to know after the denial of OPT, how much time would we have until the SEVIS gets completed?

        1 you can do reinstatement
        2 it based on denial reason you can go for mtr ..
        3 in u r case 0 days

          If u get a denial, it will be counted as 60days from ur initial OPT expiry date. From 61st day sevis will be completed. N secondly do u still have valid visa, i would suggest re-entry as reinstatement will take time.

            Also I am not sure if one is eligible for re-instatement if there is a negative decision on his record.

              I am in a very serious issue, I had a similar situation as above but just two days ago i enrolled in a school and transferred my sevis records to a different school and I got an approval for OPT extension today. What can i do now? Please advise ASAP.

                  Requesting what happened to your situation?

                  Hi Zam00786,

                  Is your situation solved? Could you please tell me what did you do after your 180 day employment period passed and did you get your STEM OPT approved?
                  If no, I'm very sorry about that. Could you please let me know how did you maintain your status since i'm in a similar situation.
