  • Questions about OPT STEM Extension

    Hello Desi OPT,

    I've recently filed my OPT STEM Extension application(Texas Service Center) and have some questions. I've unemployment period of around 180 days(including weekends). My OPT start date was Jan-23-2013. I've initially joined a consultancy on March-14 and updated my employer details to University. But I didn't fill any paperwork(I-2, W-2 etc.,) with my employer as didn't have a job. I got a full time job in another company on 1-Aug, so took it (as my consultancy was unable to find a job for me). My 12-month OPT is due to expire on Jan-22-2014. I've applied for OPT STEM Extension on Dec-5-2013. It's current status is Under Initial Review. As I didn't have any documents from my previous employer(consultancy), I just submitted the info about my current employer. Now I am worried about getting an RFE.

    1. What are my chances of getting RFE and if I do, what actions need to be taken like documents needed to support my case and/or hiring an attorney etc.,( I don't have any docs from my previous employer except an offer letter). Please let me know so that I can be prepared with those docs.

    2. Also, please let me know, if I can continue working after my 12-month OPT has expired and my case is still pending ( like having RFE on my application.)

          1 hmm post here when you get rfe ..
          Rfe can be lot.of things ..
          2 yes up to 180 days while your opt extension still under processing ..

            Don't Worry. My suggestion is to be in touch with your consultancy so that if in case you get an RFE you may be asked for the employment letters, pay stubs etc. You can work even after you get the RFE . In your case for sure consult any immigration attorney if you get an RFE. Don't take chances by submitting documents according to your friends opinion and stuff. Try to talk to the previous consultancy. All the best....

              1. You should fillw w4 fornm initially not w2 form....Let USCIS give you an RFE then we can go ahead and write replies..Don't worry about it now...

                Thank you .. but the thing is I don't think my previous consultancy will respond. As I wrote, I left the consultancy after I got job. And I have a question here with the pay stubs - My consultancy didn't run my pay stubs during my unemployment. Even if I get in touch with him, will he able to show/run the pay stubs now for that period? Also can I consider submitting a letter from a professor saying I've worked under him unpaid, during that period...? Thanks a lot again..

                  So did get RFE? I might get into same situation after few when I apply for OPT STEM Extension.
