  • RFE On OPT STEM Extension

    Hi,

    My OPT Start date is Dec 23rd 2012 and end date is Dec 22nd 2013.

    I filed my Extension on Oct 11th 2013. I got an RFE on Nov 12th.

    I am required to submit my employment history from Dec 2012 till present date.
    Names of employer, Dates of employment, position, job duties, hours worked, salary and paystubs.

    My case.

    From Jan 16th to Mar 31 I have been under an employer X1 and I was in an unpaid internship (unemployed)
    From Apr 1 till now I am under another employer X2 and i am employed and I do have paystubs.

    X1 and X2 are sister companies here and when I talked to my employer about my case, he told me he can run a payroll for me for Jan-Mar under employer X1 and get pay stubs for submission.

    So, I need suggestion as in what can be done and is this a good thing to run a back payroll or is it risky ?

    What all documents must be submitted ?
    I have seen some previous discussions about rejections when they submitted more than 3 months of unpaid jobs.

    So what would be your suggestions as in the best thing to do for me right now?

            unpaid internship = consider as unemplyment by uscis

              paystubs and client letter stating your days of employment should suffice.. from both companies

                I knew a bunch of Chinese classmates who has done this and are on STEM now without any issues

                    There is no need for calling ! all the schools in the country all saying that it is fine as far as you update your information and keep record with the school. How come that immigration office dose not inform whole the system and has an unwritten rule ???

                            1. The internship, even though it includes actual operation of the facilities of the employer, is similar to
                            training which would be given in an educational environment;
                            2. The internship experience is for the benefit of the intern;
                            3. The intern does not displace regular employees, but works under close supervision of existing staff;
                            4. The employer that provides the training derives no immediate advantage from the activities of the intern;
                            and on occasion its operations may actually be impeded;
                            5. The intern is not necessarily entitled to a job at the conclusion of the internship; and
                            6. The employer and the intern understand that the intern is not entitled to wages for the time spent in the
                            internship.
