  • Need urgent advice on immigration status....

    I really need urgent advice on my OPT status.

    I am graduating in this fall semester, but I filed my OPT application very late - my OPT application material was received by USCIS on October 29, 2013. Btw the start date on my EAD card is Dec 25, 2013.

    Before I didn't realize it took 3 months to finish the processing. Anyway, my last day to stay at school is Dec 18, 2013. So together with the 60-day grace period of F-1 students, does that mean if I can't receive my EAD card on or before Feb 18, 2014, I couldn't stay at the United States and have to go back to my home country?

    Even though I can receive my EAD card in Jan/Feb 2014, does that mean, in my situation, my 90-day unemployment period ends in Mar 25, 2014?

    Any advice would be helpful in this regard. Thanks for reading this post!

    I don't know about other things.. but.. I can say: If you have a job offer in hand, (after you receive your order receipt number), you can call them and expedite the case/ or you can still try to expedite the case by letting them know that you will be graduating by Dec 18, and you need to have the EAD, by then).

        1 u will not be on grace period u will be in status till the decision ..
        2 nope u r ead start date is the requested start date or the date of approval whichever is later .. it counts from when it started ..

            It is definitely possible to apply for OPT without a job offer. If you already have a Job offer then you know the OPT start date. If you don’t have job offer then choose a date you prefer to start, which cannot be more than 60 days after your graduation/completion.
