  • Delay in OPT denial Letter From USCIS

    Hi Every one,

    I have already mentioned my OPT was denied, i still dint get the reason of denial, its been 16days, i have seen my status online. Checked with USCIS, they told will again send the letter, But mentioned it should be received less than 30days!!!!

    1) As My OPT expired in july but as i got RFE, on which i was asked to submit Employment history documents by OCT 28th, i submitted the documents before that date, but it was denied, i want to know what status am on now?( How much grace time i have) my Sevis shows completed.

    2) Meanwhile i applied for I-20's, planning to re-enter the country from Mexico, which academic program's I-20 will be good for to re-enter the border MBA or MS ?? ( Previously i did MS in EE, want to apply for MS in CS)

    3) Should i wait for the denial reason or take the new I-20 and re-enter the country?

      1. After OPT denial you have grace period of 60 days to take decision. You will be out of status after those 60 days
      2. Depends on your interest
      3. Waste of time in waiting for a denial reason else you can apply for MTR

        Don't panic....Just wait for the Denial Letter and see what exactly the reason mentioned in that...if you think the reason USCIS mentioned in the letter is incorrect then you can file for MTR(Motion To Re-open). For this if you have to file then you need to have additional evidence, That is mandatory without that you cannot challenge USCIS. If you think the denial decision is fair then you will need to take the new I-20 from another school with new SEVIS and you have to re-enter that's one more option.

          As he said, no point waiting for an MTR if you think you are lacking in a few docs. But 60days grace starts from the day ur initial opt ends ie july somethin.. So aug n sept is 60days. U r out of status. I was through this situation n even i was confused bt the grace n i got things cleared lter.
          2) opt fr MBA till u re enter n later u can change once u re enter. Cos the CBP will definitely ask u, y do u need a sec MS wen u already have one n ur answer shud be very reasonable to him. Good luck

            Mtr takes to much time .. just step.out.and.come back with new I20 .. ms or mba both are fine ..

              If we have a valid visa , do we need to step out or can we stay here itself and join the univ ?
