H4 to F1 RFE, H4 expiring !!

  • H4 to F1 RFE, H4 expiring !!

    Hi I am student of ITU, I have applied for COS H4 to F1 on November 2012 (and completed 2 semesters with H4) and got RFE in August 2013 (as my I-20 got cancelled, i was asked to make it to initial, my finances, residence proofs in USA and india) which i replied on August 27, 2013 and waiting for the approval. I took semester break for fall 2013.

    My H4 is expiring on October 1,2013. So, my question is: What is the chance of my approval/rejection??
    If my F1 gets rejected after October 1st, can I stay in the country and file for my H4 extension?

      If your F1 gets rejected before your H4 expires, you will be on H4 and then you can apply for H4 extension. Generally the rejection chances of F1 from H4 are slim. I guess it will be approved once USCIS verifies all the documents which you have submitted. Even you can apply for H4 extension and if your H4 gets extended and then you get an F1 acceptance your H4 will be changed to F1 anyways.

        Even I got a RFE because my I 20 was autocancelled when I applied for a COS from H4 to F1. Just ask your school DSO to give a new I 20 saying initial attendance. I got the approval notice 2 weeks after I responded to the RFE. Hope this helps, Good luck.
