Hi there graduated in Nov 2012, OPT denied on June 2013, filed for MTR on July 2013...
H1B petition got approved but because I am out of status because of my opt denial I have to go out for consular processing stamping, was not able to change status. Will I have problems at consular? I noted in my ds160 form that I violated my f1 visa but explained why. I explained that I filed for opt but it got denied due to my college giving wrong i20 correction and I filed for MTR and been waiting ever since. I am told I am not accruing unlawful presence but I am in violate of f1 status. Will consular deny my visa over this? I will bring my MTR documents just in case and explain if they ask. But can they have grounds to give me problems at consular? Need to know if someone's been out of status and have their visa approved outside the US.
