From our understanding, you do need client letter for H1B Sponsorship but please do call attorneys listed on DesiOPT.com for free advice. Readers - please do share your thoughts

Yes you need a client letter. Which is the number one requirement for H1B filing.

As far as i know... you can apply for h1b but you will get an query... i think you should not wait till quota gets filled apply for h1b and this will buy you some time...

For a complete documentation for filing H1B, you definetly need a client letter. But there are some exceptions and again it depends on luck from person to person because last year for my friend who was on STEM period and was about to file an H1B. Unexpectedly he was done with his contract job. He did apply for H1 without a client letter. He did get H1 for only 1 year instead of 3 years without any query. His is filing for this year again. But I am not sure that this will happen in your case as well.

A client letter is now standard practice if you will be working at a client site as opposed to in the employer's office. As is usually the case in the IT world. If that's the case, you definitely want an end client letter. We've been hearing horror stories (mostly out of Chennai but Mumbai as well) of the consulates (at stamping) asking not only for end-client letters but end-client tax returns and financial statements. This is a total abuse of authority but it's happening. Do not take chances and make sure your documentation is complete from the beginning. That way officers are less likely to be suspicious of your petition and the rest of the process may be easier.
