  • Is it safe to travel to India with an invalid f1 visa?

    Hello guys! I am working with employer A and my H1b was approved from employer B. Due to some reasons I am not willing to work with employer B, so decided leave the country permanently. Technically, my f1 visa is invalid now because my H1b is approved and I don't have the document with me . So is it safe to travel to India with the invalid f1 visa?

          Why would India care about the status of your US visa? You are an Indian citizen, and you are entitled to return home whenever you like, regardless of your immigration status.
          Also, it’s not that the visa is invalid - it’s that you are out of status as you are in H-1B status now and not working for the employer. If you have been working for Employer A all this time, you have also been working unauthorized. You should stop working immediately and leave ASAP.
          You can also try to file a FOIA with USCIS and you may be able to obtain proof of your H-1B status. This may be helpful in the future as you are now cap exempt. Your H-1B Cap-Exempt status does not change even if the employer B revokes the H-1B as it is now past October 1.
          You may also want to talk to an immigration attorney.

            Travel, yes, very much safe.. Return, nope.. You can't without a valid visa...

              You are a Indian Citizen, you have the birthright to return to India anytime, no matter what immigration status you maintained in a foreign country.
              But apart from that, as long as you did not accrue more than 6 months of status violation, you won't face any travel ban

                You can travel, no problem with that! But if you have a transit in Europe or UK, the airlines may not let you board your flight because of invalid F1 visa. Take the pacific route.. or direct flight to be safe!

                  Being an Indian citizen, you may re-enter India any time you want.
