F1 to H1 visa

  • F1 to H1 visa

    Hi,

    I am working as a consultant and my H1 got picked up this year. I lost my project on April 8th but got a new project by June with a new client. While filing the H1 visa end client letter was missing. And now I want to go to India for my stamping so what all documents I will need so that I don't face any issues.

    Do I need to ask my employer to do any kind of amendment or I will need a new LCA? Any documents from previous employer?

    Can I go to Mexico or Canada for stamping? This is the first time I will be going for stamping.

    Any thoughts or suggestions?

    My H1 did get approve without any RFE.

          You dint mention your h1 approved? If yes, LCA needs to be done though if it is in same metropolitan city, if it's not in same city, Both amendment and LCA needs to be done. Well, speak with your attorney rather than exploring in google, I would say.

            An amendment has to be filed (one of the steps in filing for H1, including amendment, is filing and having an approved LCA - but a new LCA is not required if you are working within the same MSA) when there is a change in the employment terms (this includes a change in the end client). During visa stamping it's highly possible that the consular officer could ask for the end client letter, so it's better to have an amendment done.

              If the end client has changed since the filing, an Amendment must be done.
              If you obtained your degree in the U.S. and got your F-1 visa from your home country, then you can go for stamping in Canada.
