I got my h-1 recently and started working from Oct1, I was on CPT before (2nd masters), and briefly went out of status for a couple of days in September. I am planning to travel to India in December. Will there be any issues at the consulate for first time h-1b stamping and the port of entry regarding prevoisu status violations? I work for a direct employer and the employment location is the same as mentioned in I 797A

when you are on f1 and apply for cos with h1.... If you h1 is approved and got i94 and your sevis being active all the time... You are good to go...
Generally speaking when you apply for a visa at a consulate.... Their intent will be to evaluate you petition based on the category you have request... Most of the question would be related to h1... ,
Few others might also pop up...
Please keep both the paper works to avoid issues.... Good luckComment

My wife has simillar issue. I got my H1 and forgot to file COS for her.She is out of status for 10 days. She is going back to india for stamping but I am much worried about consulate interview and port entry. Any suggestion? waht can be the issue or how to be prepare for that ?Comment
