  • H1B transfer before october 1st (urgent)

    I'm on OPT-STEM right now and got my H1-B approved. My contract ended early this month and my H1 starts october 1st 2016. My employer said they will withdraw my H1 if I do not get a job by october 1st no mater what if some other employer is willing to transfer my H1 or not. My job and education is related to Mechanical Engineering and due to this many IT employers are not willing to transfer my H1 due to RFE issues later.

    Since my H1 is approved and if my current employer withdraws it on october 1st will I be able to go back to F1 OPT status ? Please help since time is very less as its very urgent.

    I would greatly appreciate your help and suggestions.

        You can’t “switch” back to F-1/OPT once your status changes to H-1B. If, however, you leave the U.S. now and enter back in October with your F-1 visa, you may be able to remain in F-1 status and that will cancel the H-1B change of status. However, your SEVIS record is most likely set to close on September 30. You need to speak with your DSO about making sure the SEVIS record remains active after September 30 so you can come back in F-1 status.
        Once you are back in the U.S., you will still be cap exempt if you can find an employer who can file a new H-1B petition for you (you don’t have to go through the lottery and cap).

            Make sure that your sevis is still active... This is the only way to come out of the situation...

            You are very close to oct 1... If he cannot hold it for few weeks then tell them to withdraw it now... Good luck
