Urgent H1B Issue on cap-gap, please help

1) Since you are in capgap you are not allowed to work after sep 30 if your H1/change of status is not approved by then.
2) if end date is mentioned on thr client/vendor letter most probably H1 will be approved to the mentioned date. Try to gather letter from client.

Ps: this is not a legal advise , just a suggestion

My OPT STEM extension expired in Jun 2016 and my H1B is picked in the lottery in the regular processing. I am currently working for a client as a contractor. I am currently on cap-gap valid till Sep 30 2016.

I still have not received any RFE and my CASE status still shows received. My client is not giving the client letter and the vendor gave letter that my project is till Oct 31st, 2016 and is expected to be renewed

1. Can I still work after Sep 30 if my case is still processing? What will be my status then
2. I am planning to apply premium on that and what will happen if vendor letter shows Oct 31, 2016


Any help is really appreciated

1. If you are only covered by Cap Gap, you must stop working on September 30 as work authorization does not extend past that. You can stay in the country.
2. USCIS can limit your approval to October 31, 2016.
