  • Is H1B still valid

    Hello Friends,
I was selected for H1B lottery in the year 2015 but I resigned from job in July, 2015 and returned back to India in Aug, 2015 (I had my OPT STEM Extension approved as well at that time). Now, I am planning to go back to the US. In such a case do I need to again go through the lottery process ?
What steps will my employer will have to take ? I am finding a job currently in the USA.

You say you were selected, but was your H-1B actually approved? If your h-1B was withdrawn before it was approved, then you have not been counted in the H-1B cap and you will need to go through the H-1B lottery again. If the petition was actually approved, you should be cap exempt.

I have received a I797A-Notice of Action with Case Type : I129 Petition for a non-immigrant worker and the document says the above petition was approved. I think this is the petition document and it says its valid till Aug 2018.

So, if i find a new employer they just need to file a new I129 petition form ?

                    Thank you.
