Change of employer before H1B is Approved

Hi All,


Thank you for all your valuable suggestions over desi opt which is helping alot for students like me.

Here is my situation, my previous employer(Consultancy) filed for my H1B on April 2016 and the application got picked but i got a RFE. I am not able to answer RFE because i could find a contract position through my employer.
So, I started applying for full time position and i found a company willing to hire me as full time employee and they are interested in filing for my H1B next year. But my current OPT expires by DEC and i'm running out of options.

My question is, is it possible to transfer my pending application to the new company ?.

Any advice is much appreciated.

Application cannot be transferred before its approved. Apply for OPT extension if you can.

tell your other company to respond to the RFE. You can transfer later if it gets approved

You are not counted in the H-1B cap until the H-1B is approved. Therefore, your H-1B can’t be transferred until it’s approved.
