  • H1b approved status. Job lost before 1st Oct. Currently on 17 month OPT

    Hi,

    I am looking for a solution to save my H1b or else ways to invoke my F1 status.

    I lost job with my agency who sponsered H1b. And, they are currently looking for another job for me. However, I am worried if they aren't able to find me a new job then I will lose my H1b.
    So, If I find myself another job then is it possible to transfer my H1b before 1st OCt?
    What steps do I need to take after getting another job?

    What should I do if my previous employer doesn't find job and revokes my H1b before 1st Oct. Would my F-1 status be activated?

      You need to speak with an attorney. An H-1B can be filed before October 1.

          You cannot transfer your H1 before oct1st you have to be under the same employer for at least 45 days . so u have time you have to be in job by oct. so start searching aggressively.

            I am an Immigration Attorney and have helped folks in similar situations. If you are currently on H1B, your F1 status will not be automatically reinstated if you lose the H1B. I am happy to consult with you on different situations which may be applicable to you to obtain green card or visas. You don't have to look at traditional employment possibilities.
