Cap Gap Validity

Hi Advisers,
My H1-B got picked in the lottery and Status is still pending and my Cap gap is approved till September 31st.
I had a question, If my H1B Status is still pending after September 31st, will my cap gap extend automatically or will it end.
Will I be still in status to work or not
Do I have to take any necessary steps
Please guide what can be done

You will remain in status and can stay in the US until the H-1B is approved. However, if your OPT has expired, you must stop working on Sept. 30, as that is when Cap Gap ends.

you can remain in usa till the decision is made but cannot work in usa until it is approved

Hello lissanderson,

I'm a similar situation.

An RFE is pending for the H1B application. At the same time, the 24-month STEM extension is pending as well.

Would I have to stop working after September 30th, even with the STEM pending?
