Urgent Help - Change Employer when H1b is in Process
I'm a Masters graduate currently working for a consultancy. I have my H1b petition filed through my consultancy which got selected in Lottery but there is no update on the Status yet. Also there is not scope of getting a project through this company as there is some audit going on.
I am currently attending for a Full time position with a reputed company. I told them I'm an OPT student who has still 30months OPT left(with extension) and willing to join immediately.
1. If I change my employer and join immediately, what will happen after Oct 1st(if my petition is approved).
2. Would I be able to continue in my new job as OPT?
3. Can I transfer and cancel my petition? What should be the best thing to do?
4. What should I tell the new company about this H1b? (I'm worried if they will be willing to sponsor(for H1b transfer) immediately after joining?)
5. Also, I is there a rule that I need to atleast work for 3payrolls before I can transfer my H1b to another company?
I request you all to please assist me on this as I need to make a decision soon.
