  • H1 status "Decision Notice Mailed".

    Hi,

    I'm currently working on OPT. My H1 got picked in lottery and I got an RFE in last week of May. My Employer mailed those required documents in June last week. I have checked my status today it says "Decision Notice Mailed" and the description says "we denied your Form I-129".

    Is there any chance of my H1 getting approved in this case ?
    Is there any procedure to follow?

        In this case if your employer does not agree with the decision he can file motion to reopen... Will take a long to time to get a decision on this case...please consult a lawyer after you get the letter and what was your employers response... Good luck

          My brother's H1 was denied last year and his employer filed MTR in November 2015, he got approval in March 2016. Good Luck!

              You can file a motion to reopen. Decision is anywhere between 9 - 18 months after you file a motion, but if you are sure that everything in you application packet was correct u should file it.

                  There’s no way to know if you can ultimately get an approval until the decision arrives and you are able to see why USCIS denied the petition. Then, the employer must decide if they want to file a Motion to Re-open the application. If they want to file an MTR, the employer/attorney must prepare and file the I-290B, with filing fee, with USCIS within 30 days of the decision date (33 days if the denial was mailed).

                    Hi Rajiv,

                    Did your employer file an MTR?
                    I also got denial mail after RFE. Please let me know if you get approval.
