Can we apply for STEM Extension after OPT is expired & H1B gets denied

Hi ,

I was told that there is a possibility of H1B petition might get void if we apply for STEM Extension after H1B petition got picked up in the lottery by my university . So I didn't apply for it and OPT (12 months) is expired. What are the circumstances after H1B is denied. is there any possibility to apply for STEM Extension at that time ? Please advice. Thanks

NO, I'm pretty sure no university will advise that , but if they did they were wrong .
Pack your bags and leave within 60 days or your chances of coming back to USA in future will be low.

Since you are technically in F-1/OPT status through Cap Gap, you can still file a STEM extension now. If the H-1B is denied, Cap Gap is terminated and your 60 days of grace begins and you will not be able to file for the extension at that time. Here is information provided by USCIS: https://www.uscis.gov/working-united...gulations#stem.

If filing for an OPT STEM extension would cause an issue with the H-1B, why would USCIS post information about it? What the DSO said is incorrect.

If you want to have a back-up option in case the H-1B is denied or revoked/withdrawn, then file your STEM OPT extension. If the H-1B is approved, you can always withdraw the application for the OPT.
