H1b approved 2016, can change employer before October 1 ?

I faced a similar situation last year and this is the reply from my attorney."A new development has come to light from the USCIS. It seems that USCIS has been denying cap subject petitions with validity dates of October 1, 2016when trying to transfer. Reason being that the "current" H1B is not valid until October 1, 2016 therefore that status is not valid. If the "current" petitioner withdraws the H1B then the candidate,will not have a status and will be cap subject again. If the case is filed and the USCIS denies it but the current petitioner has not withdrawn the H1B, it will still be valid. Based on these new developments we would caution against filing until after October 1"
My H1b case got approved on June 2016, can I change my employer (H1b transfer) before October 1 ?
It is possible for an employer to submit an H-1B transfer before October 1. However, there are reports that USCIS was issuing RFE’s for some cases last year when this was done. Some attorney were able to get them through and others were not.
