H1B still pending

Hi

My H1b for fiscal year 2016 is still pending. I got an RFE to prove the Inhouse Employment. My Employer replied to RFE and USCIS recieved my doccuments for RFE on Sep 10 2015, after that no status has been updated still now. Now I am working at the client location and they are willing to provide me the client letter. My question is Can I apply for another H1b petition for fiscal year 2017 with a different employer while my H1B for fiscal year2016 is still in pending.

High chances of denial of both petitions if you do apply especially since you already have a rfe on the first petition. So I suggest stick with the one you have.

If you are applying through new employer then you should be good else if you apply through same employer(last H1 employer) then USCIS treats it has duplicate application and rejects both

Why don’t you immediately upgrade the H-1B petition to Premium Processing and get an answer as to whether or not you have been counted in the 2016 cap?
