Travelling to India during H1B amendment in process

Hi Everyone,

I am travelling to India during December, my lawyer applied for H1 amendment and told me that it would take 5-6 months to get the approval notice. Is it safe to travel to India and go for H1 stamping with I-797 Approval Notice and copy of my application to show that I have an amendment pending .

Trying to get back into the country based solely on an application recieval notice is not going to work, while you may be able to stay in the country legally comeing and going are a diffrent issue. I would say not to leave the country without this issue being resolved first.
