First time H1B stamping

  • First time H1B stamping

    Hello All,
    My H1B was filed under consular notification this year and it was selected. I need to get the stamping done to activate it. I have a couple of questions for you guys and any help is much appreciated.

    1.
    The consular listed on my I797 is Chennai, India. I am a resident of Mumbai. I have mailed my attorney and they say its fine if I get the stamping done from Mumbai. Should I request a change of consulate with USCIS ?

    2.
    I have a Canadian Tourist visa. I am also considering the possibility of getting the stamping done from Toronto, Canada. However, I have been told by some friends that it is mandatory to get the H1B stamping done from their home country the first time. Only renewals are allowed in Canada.

    3.
    Also, I spoke to my attorney regarding changing the consulate of my I797 if I go to Canada for stamping. Their response was same as in the first case.

    Please advise.

        1) No.. You can go to mumbai
        2) no as far as I know you can go anywhere... Canda do take first time applicants... I had similar situation
        3) no need worry about that it time consuming
        Get all the docs you can as that will be more helpful... Read some interviews online to get a better understanding... Good luck

              1. You don’t have to make any request to USCIS. You can simply make your appointment for Mumbai.
              2. If you were in the U.S. in F-1 status and you obtained your F-1 visa in India, you should be able to get the H-1B in Canada. However, I would go to Ottawa or Quebec City.
              3. Your attorney is correct. No need to do anything.
