H1B approved with old I94 number

  • H1B approved with old I94 number

    Hello,

    I am on F1 visa in US.My H1B petition was approved last week. However, while applying my employer mentioned the old i94 number instead of the latest one,
    as I traveled to India in the month of mid March and my employer did not have time to update my application packet with the new i94 as I returned in March last week and hence had new I94 number.Now the H1B petition approved has the previous i94 with new dates. My latest i94 has validity until Nov 2015 and the old i94 number with H1B approved has validity dates from Oct1st 2015 to Sep30th 2016 .

    1) Would this create any problems for me in the future especially when I go to visa stamping or when I try to re enter US after visiting other countries?
    2) Can I work on H1B starting from Oct 1st?
    3) I heard that in such a scenario, the beneficiary needs to cross US border and reenter again before Oct1st. Is this true?
    4) Do I need to talk to my attorney and file for H1B amendment so that the I797 approval notice has the new I94 number?

        your change of status is not valid anymore , because I94 is different now

          it means in order to change status to h1 you must go out of usa get h1b stamped and come back

            The discrepancy shouldn’t really have an effect on your status, and your status will change on October 1 to H-1B.
            However, you should speak with the attorney and address your questions to the attorney. They are the only true experts. First, did you or your employer tell your attorney about the new I-94 and travel? The new I-94 could easily have been updated before the H-1B was filed.

              I have same issue but i was on H4 visa and change of status(H4 to H1B) got approved with old I94.
              What shall i do now?
