Attorney fee!!!

Hi

One have a question regarding attorney fee for H1B application.

If the application is not picked in lottery & the packet gets returned, does attorney charge any fee for that application or does both application fee & attorney fee both are returned to the employee??

Most attorneys keep the legal fee even if the H-1B is not picked in the lottery (unless the employer can show that the attorney did something wrong that caused you not to get picked). If the attorney did all the required work, then he or she should get paid for that work. USCIS returns the filing fee checks with the petition.
