  • Obtaining Client Letter from Govt. client for RFE

    Am currently working as a contractor with a Federal Client. My H1B application got picked up in lottery this year. Got an RFE for which my employer says we'll require client letter. When I had joined the project 6 months back, my manager at federal had refused giving client letter saying its against their policy. Now my employer says I need to anyhow plead my manager to provide client letter for me to be safe. I am stuck badly.
    1. How and what shall I communicate to my manager?
    2. What other alternatives I have to make my case stronger to get approval?

    One way is pleading and convincing your manager for client letter.
    Another way is to submit your ID card picture and timesheets to prove Employer Employee relationship to the USCIS. Thats all I could think of. Is your case number starts with WAC or EAC ?

        Hello, thanks for responding. My case starts with EAC.
        I pleaded my manager today, but he refused saying its not in Federal policy to provide a client letter. He cross verified with their legal team.
        I am going to submit my ID card, time sheets and some pictures I have clicked while working on my desk.
        Also my employer is planning to get an affidavit signed by one of my co-worker who also is a contractor.
        Do you think this all will work?

          WAC is safer than EAC

          WAC is a safer zone to apply than EAC....I have heard no client letter RFEs in WAC centres but a lot of RFEs from EAC zone for client letters.....
          Coming on to your submission of documents.... I cant promise anything...it depends on officer handling your case.....best of luck....

            In most cases, USCIS needs some proof of the end-client/employer relationship through either client letter or a copy of the agreement between the 2 parties. If the contract/agreement is not available or cannot otherwise be submitted, a client letter is usually needed. You need to convey to the client that if they don’t provide something, the H-1B may be denied and you can’t work there anymore.
            Without knowing exactly what the RFE is asking for, it’s difficult to advise what other documents can be given.
