Who gets to keep the original H1B approval notice I-797A ?

  • Who gets to keep the original H1B approval notice I-797A ?

    I got my H1B approved and my lawyer sent my company HR the approved I-797A. My HR then read the form and it is mentioned in the second para on the notice that:

    [B]The petitioner should keep the upper portion of this notice. The lower portion should be given to the worker.[/B]

    So, she is going to give me the lower portion of the approval notice (containing the I-94).

    But, the Visa Officer might ask for Original I-797A at the time of Visa stamping. As this is the first time the company has sponsored the H1B visa, HR is not aware of the issues which an immigrant has to go through to get visa stamped in the passport. In this case, how shall I convince my HR to give me the entire original approval notice and not just the lower portion containing the I-94 ?

        The employee. You need the original I-797A at the point of immigration when you travel.. Also when you go for stamping of the visa you need that.

                Ask the employer to speak to their attorney. Most attorneys will recommend that you take the whole notice. You can tell the HR person that if the officer wants to see the entire notice, you may face significant delays in getting the visa.

                However, the officer should have a record of the H-1B approval in PIMS. If the officer asks for the entire notice and you notify him/her that the employer has kept it as per the USCIS instructions, the consular officer may not give you any problems.
