H1B Approved, Laid off, Transfer before Oct 1

Hello All,

My H-1B got selected but I got laid off as my company shut down my department.
They are going to keep the petition open until Oct 1 (promised as exit pkg)
Left the company on Apr 30th

A new company may give me a job but their lawyer is afraid my new petition/transfer might get rejected as USCIS will count me cap subject. will file premium

I am on OPT extension valid till Nov 2015 (H1B was filed consular notification) so still in OPT status.

Have a degree from good school and worked with for top companies always.

Is there no hope or there are chances that I get it transferred as it is an unfortunate case?

The only way I could think off is ask your company to take chances...

I am planning to ask them to file premium and I join them only after they have a decision, which would be in 2 weeks correct?

Is this a wise approach?

Yes its good...
Approval solely depends on the USCIS officer handling your case.... I have seen cases being approved and denied(50-50 chance) who tried to do transfer before Oct 1.
Yes dont start working without final approval

How safe is it to move to f1 temporarily and then when you get job move back to H1b ? Has anyone tried that option

Hi. I got H1 approved and was laid off on mid-June and I am still looking for a new opportunity. Unlucky. I almost lost my hopes in USA and decided to move back to INDIA.

Wanted to know how are my chances of me coming back to USA for work in the future. Will withdrawing my H1 application help me in the future or not?

h1 is dual intent immigrant visa and f1 is non immigrant visa ....so it will be very difficult to move from immigrant to non immigrant visa, expect RFE for sure

Hmm . duel intent does not cause any issue to cos to f1

On other side u can choose tourist visa rather than f1 ( B visa u dont need to pay school fee )

Wanted to update

New company applied for me petition as cap-exempt in premium as notify the consulate, got approved in 7 days.

I'm not sure if this was a lucky break or they have started accepting such applications, it was not filed as change of status BTW.
