Difference between H1B sponsored by Higher Ed and Company

Hi Everyone,

I am a recent graduate looking for full time positions and I would like to know what is the different between the h1b's sponsored by a higher education for a staff position and a company? I have heard that if we work in a higher ed then we will have to only work for them? Is that true? Please explain?

Non-profit universities and colleges (institutes of higher education) are exempt from the H-1B cap. You don’t have to go through the H-1B lottery to work there. The problem is that if you work for them but then want to change your employer to a regular company, you will then have to go through the H-1B cap. It doesn’t matter that you are already in H-1B status. Since you were not previously counted in the cap, you need to go through the H-1B cap and lottery. You can find out more here.
