H1B not picked... Extension Option

  • H1B not picked... Extension Option

    Hi,

    Unfortunately my H1B was not picked this year. Since my school/ course is a STEM approved one I have the option of going in for an OPT extension. However the company I am working with is not E-Verified.
    Since they know that I will not be able to continue working with them they are ready to get E-Verified now. My OPT expires towards the end of September 2015. Do you think there is time for them to get E-verified and then for me to apply for an extension ? Is there an option to file for a GC since they are ready for that as well.

        1 before u apply they have to be everified
        2 if u are not indian or not from china then yes ..

          1. Yes, it is fairly quick to get e-verified.
          2. Yes, they can file for GC but it all depends on the priority dates.

            1)the company should be everified before you apply stem 2)you can apply green card on any visa thats not a problem

              E-verification is a quick process. You should ask your company to become e verified

                If someone files a green card from f1 in EB2
                What status are you in for next 5-6 years till it gets approved ? ( are you allowed to travel in that period or it will be kind of cap-gap period ? )

                  yeah thats where H1B helps and is justified since EB-2 is employer sponsor mostly.

                    Not on f1 .. F1 is not intent to immigrate so u may face issue at 140 .. If applicant pd is not current

                      There should be enough time for them to become E-verified if they start now.

                      They always have the option to start the GC, but the GC process does not necessarily keep you in the country or give you the ability to work until the third and final stage (Adjustment of Status).
