  • H1B selected but employer paying low wage.How to switch peacefully

    Hello All! I am on OPT and got my H1B selected in the lottery and is under further process, but my employer is paying very low wages. I took the current offer as i was scared with the job search and didn't want to wait for better opportunity. I signed a 1 year contract. In recent times, i am getting better offers which is paying twice than what i am getting now. I have a lot of financial commitments too. What are the worst things my employer can do to me. How can i negotiate in a peaceful manner.I have only one more chance for H1B, if i lose this. I don't have too many friends to discuss about this. Any advice would be highly appreciated. Thanks a lot.

        The worst thing your employer can do is withdraw your H-1B before it gets approved. If that happens, it’s as if you weren’t counted in the cap. You will not be covered by Cap Gap, and you will have to go through lottery again next year. You may be getting better offers, but it may be in your best interest to wait until the H-1B is approved.

          Oct 1is the safer time switch ( if cos is approved ) .. Untill then u have risks about u r h1

              Honestly, I can understand the financial scenario, but trust me my friend, H1's are not easy anymore, you are lucky that you got it, try to peacefully negotiate, if not, complete your one year contract and try to transfer your H1-B, Good Luck!

                1. They can withdraw your application if you leave them without proper notice and negotiation.
                2. You know your employer better, keep it simple and convince them.

                          There is no bonded labour in us as far as I know. But he should take legal advice
