  • Can Employer be Changed after H1B Petition is Approved?

    DesiOpt, Thanks for all the help. I am in a very confused state and have been getting different opinions on this. I work for a Company A ( Manufacturing Company ) who filed for my H1B. It got picked in lottery. I have received my I-797. I graduated in Dec -14 and been with A ever since. Now I have got a very good offer from a Company B ( Manufacturing Company ). They are ready to sponsor. But my question is can I transfer my approved H1 or need to cancel my petition in order to join B? I am on OPT currently.

      You cannot transfer before your FIrst H1B start date....Chances are there it might get rejected....

          USCIS will most likely not accept a transfer petition until after October 1. If you have an approval already, you can join Company B using your OPT, but Company A will most likely revoke your H-1B. You should still be able to transfer your H-1B as you have been counted in the cap and you should be able to continue working regardless of the H-1B revocation as long as your OPT remains valid.

                  U have to transfer when it is active .. employer a may revoke if you let him know that u are changing
