H1 B . Withdrawal

Hi,
I am masters student with OPT and STEM.
I got a fulltime job from a company(A) who applied for my H1-B.
Now i got another job from another company(B). I wish to join company B only.
I graduate in May and have applied for OPT.
My questions are :
1> Till when can I withdraw my petition?
2> Company B has promised filing next year so will there be any problems?
3> I want to travel to India in May- June will there be any problem?

1. You cannot withdraw the petition. Only the employer can do it, and it can be done at any time.
2. There should not be any problems.
3. You cannot travel until your OPT is approved.

my advice would be dont withdraw....getting H1B picked up in lottery is like a boon ... go ahead with your H1B and then do a transfer later to some other employer(I know Emp B wont wait, but to some other employer I mean)...... next year if you apply for H1B, the number of applicants will be around 270k from which only 85k will be selected....your chances of getting selected is very bleak.....so think wisely.... this is just my friendly advice and not a legal advice.

Lets wait an watch if your lick your application will be picked... then responding to query if any and then approval
You are on opt so if you have paper work you can travel
once you application is picked your employer can withdraw it... please talk to a lawyer for more specific details ..

I personally feel if your application is picked dont withdraw it as it not that easy to get an h1b picked and approved... good luck

I too advice the same, if your h1b is selected and approved, go for transfer after while but don't withdraw..lottery is not as easy as b4
