Cap Exempt h1b

Hi,

If I obtain H1B through a cap exempt employer and later want to apply for Green card, How does that work.

I have heard that during green card application, If one obtains priority date, one can change companies easily without loosing priority dates.

Can I also change the company after obtaining priority date, and not applying for H1B again? or I will have to apply for H1b again (Moving to Capped employer). I will be capped and have to go through lottery ?

Also How long does it take to obtain priority date and obtaining Green card application for Indian nationals.

1 Same as cap subjected h1 . i can keep date only if u r 140 is approved .

3 PD is the date when u apply for u r first stage (PERM) .. In order to keep that date even u move to other company u have to get u r 140 approved with that company ..

Yes you can keep priority date when you move employers as long as your work is the same and pay rate is same or more.

Every employer you move to, should keep filing H1b and Greeen card process over and over to be able to retain the priority date.

Obtaining priority date means applying for Perm. It shouldnt take more than 4 months but approvals take years.
