    Hi,
    I am a masters student and will be graduating in May.2015 this year. i will be joining full tym in a company on July 27 this year. The company is fiing H1B for me this yer itself. My question is after i graduate i am planning to travel to India from May 12 to July 27. I wanted to know if there will be any issue if i travel when my h1b has been filed. my application will be filed in premium processing and they said i will get to know the results before may 12. i will have my EAD card and opt i 20 when i will return back on july 27. So if the h1b is not selected in the lottery this year for me then it is fine but if it is selected can i return back to US showing my EAD card and opt i20? will it create any issue?

        you need to get travel i 20 from the university and see that your information is upto date. no issues you can travel

          1. If you are following h1b news, the premium processing this year will start May 11th. So in all probability their is no chance if getting approved the next day. Just an advice which even my legal rep gave me last year and i guess all H1b applicants are given by their attorneys, not to travel until your petition is approved and you have the approval letter.

          2. On the OPT front you should be fine, offer letter, OPT I-20 with travel signature and any pay stubs you have if you worked for the same employer prior the leave the country. Also to be very safe have a letter of vacation from your employer.

            Generally its not a good idea to travel while change of status is pending. But if you need to travel then make sure you also have a leave approval letter from your employer in addition to the other documents already mentioned.
