  • Applying for H1b first time in April 2015

    Hi everyone,

    Completed my masters and currently on OPT. My current employer will be filing my H1 in coming April 2015.

    However, recently the client where I work has initiated interest to apply H1 as well. They are also willing to co-operate providing client letter for my current employer to file my application. Is it fine, that my employer files my H1 application with client letter and my client also files another application for me as a future employee?

    My client does not have issues, if H1 is approved for my current employer. But if it gets approved for client's application, then I would have to continue with them. Both of them will be applying unders Masters category.

    Will there be any issues, if both applications were selected?

        You can file any number of petitions as long as you are not filing for the same job. From what you are saying, looks like your client is filing for the same position. That is not allowed. I am sure yr client lawyers know this and will file yr petition for a different position.

          i recommend go with your client to process your h1 In this way you get good pay than your employer and you wil be safe

            I hope your employer isn’t a basement company because such questions should be answered by their HR.

            As long as one of petition’s mentions it is a concurrent employment petition you shouldn’t have any problem.

            Make sure your client and employer attorney are notified of this and one of them should file 'concurrent' application

            There is a pending rule on the books which prohibits one employer to file two petition’s for the same job but it is not approved yet and slated for approval on the Mar 31st 2015 Night.

            I am just a HR guy and not an attorney. My suggestions are from experience and should not be considered as legal advise. Always contact an Immigration attorney for legal advise.

              U cannot apply from 2 places, if both get selected they will disqualify ure application

                  Technically u can file .. But u have to be very carefull to explain both jobs are valid .
