Qutting job on H1B Visa

    You are out of status as of the last day of work. If you plan on staying in the country for 1 month after leaving your job, the correct method is to file for Change of Status to B-2. While it may take 2-4 months to process, it doesn’t matter in your case as you will leave before the decision is made. Once you leave, the application is considered abandoned but at the same time, you were in status because the application was pending while you were here.

    Once you leave, make sure you keep the B-2 receipt notice in a safe place and keep all records of your exit from the U.S. and entry into your home country. Also, keep any eye on the application to see what happens. Make sure the address you use for the B-2 is an address where your mail can continue to be delivered after you leave.

    Hi,
    It is advisable to have a paystub till the last week you are in India. This becomes relevant if at any later point of time, you want to apply in the CAP Exempt scheme. For that, you should have maitained your legal status ( which means that you should have been working and paid for that period)
