Traveling when H1B is in process

Hi,

I am currently on OPT and applying for H1B this April. My OPT is valid for the next 17months.

Our family is planning for a ceremony in India on April 3rd and I am planning for a trip to India from March 20th to April 15th. I am not sure how this will impact my H1B application.

1. Can I be travelling when H1B is applied (March - April)
2. Can I travel while H1B application is in process (April - May)
3. Can I travel if he has a decision on H1B (Post May, if H1B is applied through premium processing)

1. Yes, you can travel as long as you have a valid F-1 visa in your passport and you have a valid OPT card. However, your H-1B change of status will be cancelled if you travel before it’s approved. This means that if your H-1B is approved, it will be approved with consular processing notification instead of as a Change of Status with I-94.
2. Same question.
3. Yes. Once the H-1B is approved you can travel. Once the H-1B is approved, even if you travel, the change of status will go into effect on October 1.

If you are planning on travelling, make sure you tell the attorney who is filing the H-1B. They need to know this information.
