  • H1b Transfer RFE

    I recently got an RFE for H1b transfer. I started working for the new employer with h1b receipt. For the RFE, they required to show that my employer has right to control on me not the end-client. There are three layers between my employer and end-client (Employer -Vendor 1- Vendor 2- Implementation Partner - End-Client). I requested end-client for a letter with my employer name who has right to control on me. But, the end-client gave me a letter stating that Implementation Partner has right to control on me. I even requested the same letter from Implementation Partner, they too gave a letter with their name as right to control instead of my employer name. How to get a letter that states my employer has right to control? My end-client and implementation partner are not willing to give a letter with my employer name. Could you please help me on this?

    I really need your inputs. Thank you so much in advance.

      Your employer and your employer’s attorney need to be coordinating this, not you. If the End Client and Implementation Partner won’t give you appropriate letters, then you cannot submit those letters, and other supplemental evidence must be given. Try to get the appropriate letter from Vendor 1 and 2, and also ask Vendor 2 to ask the Implementation Partner to issue the correct letter.

          1 provide evidence that u r employer doing u r performance reports ,status reports , assigning tasks ,meetings with employer about how to finish tasks ..etc .can evidently prove that u r employer have control over u ..

            you can provide the immediate vendor or middle vendor letter which states that your employer has right to control and then provide employee and employer relationship

              this way is more tricky .. u r attorney and u r employer should know what they are doing
