  • Filing H1B before Graduation

    I am graduating with masters in May 2015, and I've got job which starts in august. My company is ready to file for H1B in April 2015 before my graduation. Would USCIS consider me under masters Quota, if not then what are the options to get through this year.

        Unless you have completed ALL of your degree requirements as of March 31, 2015 and your university is willing to issue you a letter confirming that, then your H-1B cannot be filed in the Master’s Cap and must go through the regular cap based on your previously earned Bachelor’s degree.           you have a have a master certifacte and graduated before you apply for h1 then only you will be considered in masters quato you can apply for h1 in general quato this year

            U should have ur degree certificate when applying for ur H1b to be considered for Mater's quota. However, yes you can apply in the general 65K quota for your H1b

                What if you are already on F1 OPT ( all course requirements met)? Is it okay to provide just the transcripts and provisional ? Will you be eligible for MS cap in this particular case?

                    You need Degree with out degree u will come under normal Quota ( lottery) and you will get only one chance. with degree you will have 2 quotas and ur eligible for 20k quota and 65K quato.

                      You must possess the masters degree when you apply for your H-1B to be considered in the masters quota. However, you can apply for the H-1B this April, and then apply again next year under the Masters quota if you do not get selected in the lottery this year. You may also look into hiring your own attorney to get these questions answered so that the H-1B process is more transparent for you. Good luck!

                        you will need the degree or at least a provisional certificate or letter of completion.. both of which will only be issued after you complete your courses.. but if your employer is willing to apply then its great as you will get 1 more chance to apply. with a lottery almost certain every year .. you wanna try as many times as u can..
