Hello All,

I recently finished a contract with my desi company. I am on bench. I got an offer with large client through an american employer randstad. Can I transfer my visa? Please advise pros and cons.

You can and should transfer your H-1B employer as you are out of status (you’re not allowed to be benched while on H-1B). The question is: should you apply for extension of status or does a consular pick up H-1B? With extension, you must submit pay stubs; if you don’t have pay stubs, USCIS can come to know you are out of status and the H-1B extension may be denied. Depending on how long you have been benched (more than 1 month), you may want to consider H-1B transfer with consular processing. You may want to speak with an attorney as soon as possible.

Make sure if the American employer can sponsor GC in EB2.

Make sure he gives enough time to search new project when you are on bench as they usually revoke H1 after 1 month.
