Hey All,
I would like to get some clarification on my current situation and what i can do??
I have received my approved OPT valid from 20 Jan 2014 – 19 Jan 2015.
I had applied for an extension in the month of Oct 2014 for which i received an RFE only in January. I responded to RFE on Jan 14th,2015.
It is in review stage.
[B]NOTE : My original 12-Month OPT card already expired but as per uscis website i can continue working.[/B]
(As mentioned on uscis site : automatically extend the student’s work authorization for up to 180 days while the student’s 17-month extension application is pending.)
Now, i need to file for my H1 this year 2015.
I would like to know if :
1.can i file for my H1b while my OPT extn is pending with uscis ??
2.is it is a must to have a LCA approved before filing for H1...So, Can i start filing LCA now without my new EAD card ??
3.Any other suggestion on my case ? (My case is pending with uscis) please help me here..
I hope there will not be any kind of an issue with regard to the required documentations for H1 without my new STEM OPT EAD card.
Please advice asap.
