  • H1B and OPT extension application together

    I am doing Instructor job in a University. They are going to file my H1B which is Cap exempt. My OPT will expire in 23 June.
    they said it will take 4 months for H1b processing. I am worrying about If it takes more time than my OPT expiration date, then I may have problem. My questions are:
    1. In this case, can I apply for OPT extension also? (I qualify for extension)
    2. In case, My H1B does not get approved, Can I work with OPT extension?

      The only problem you will have is that you won’t be able to work continuously if your OPT expires, and H-1B is still pending. You can continue to remain in the U.S. and wait until the H-1B is approved. You can also file the H-1B as Premium Processing to get a quicker answer.
      You are allowed to file a STEM extension even when an H-1B is pending and can use the STEM OPT if the H-1B is denied. It’s unlikely your H-1B will be denied if properly filed.
