  • Change of Client During H1B Processing

    Hello Guys,

    I am currently working on OPT-Extension for an Employer(Consultancy). I want to file H1B this year.
    I will be with the same employer during the processing time but I have to change my client(I mean project) in July.
    My contract ends with my Client in July 2015.
    1. Do you recommend doing this? Or It's better to change the project now (before filling H1B)?
    2. My current client also don't offer client letter according to their company policy.
    Is it OK to manage with the emails which I can get from my manager that states I am working for them but can't give a client letter?
    3. Will premium processing helps me to get approval soon by July and I wouldn't have to worry about my change of project in july?

        When filing the H-1B, your employer and the attorney must submit a valid contract or client letter to show that you will be in status for the duration of the H-1B. If you give the July contract only, they will deny the H-1B because you won’t have work on October 1. You need to have a contract that is valid beyond October 1. Additionally, if you get a new project, your H-1B will only be valid for as long as your new contract is valid.
