  • 1 day CPT universities-issue for H1B?

    Hello All,
    If I am enrolled into a university which provides CPT from day one, could it be a problem in getting H1 application through?

      Yes, it can. The problem is not that the school is offering CPT from day one. The problem is some schools allowing students to do CPT even when working is not actually required for the course.
      Under the regulations [8 CFR 214.2(f)(10)(i)], CPT is defined as “alternative work/study, internship, cooperative education, or any other type of required internship or practicum that is offered by sponsoring employers through cooperative agreements with the school.” Over the years, some schools have taken a more “expansive” view of this requirement. In the last year or so, there are reports that USCIS is questioning F-1 students who did CPT on whether the CPT was actually “required” for the course. This could have an effect on the ability to “change” status to H-1B as USCIS may make a determination that that the CPT should not have been authorized. There are reports online (you can check forums) of people getting RFE’s for this type of question.
      Whether or not this is the correct interpretation of the law is unclear, but this is what has been happening.

              No. You might get RFE which is normal as long as you can justify yourself with right paper work. All the best.

                Statistically lot of people were getting rfe to prove maintenance of status and lot were getting 797b .. So be carefull

                      Ice made official that college can provide Cpt from day 1 based on the type of prog...so is k no issues

                        It in CA also provide cpt from day 1..as long as you are good with the paper work there won't be any isuue.. #goodluck
