H1B approved, OPT 90 days unemployment nearing end

  • H1B approved, OPT 90 days unemployment nearing end

    Guys,
    I graduated on August 2014 with master's degree (computer engg.) on F1 visa. My H1B was approved on Oct 2014 through a consultancy company, and I received my OPT card on Nov 5, 2014 (applied as backup). My 90 days of unemployment will end on Jan 5, 2015 and I have a few questions:

    1) I am still on bench looking for new job. How long can I stay on bench under H1B visa ?
    2) Do I need to update/inform my DSO about the change of address that has to be done as soon as one get a job on OPT(in my case I don't have a job yet) ?
    3) If I have to do the above, what should I put as the starting date of work and what address should I put in (as I not moving to anywhere right now) ?
    4) My company has not filed for my change of status, they told me they are waiting for me to get a new job and then they will file for amendment of H1B (change of client name I worked under CPT and change of status).
    Does it mean I am still kind of on F1 and have to do the basic steps of informing the USCIS as one do on OPT ?

        4. Without COS ur still on F1 and I guess u need to maintain it.
        Above answers are as per my knowledge, still I would suggest asking these to ur attorney who can guide u properly.
        Can owner of this post(Queries) inbox me plz? I have kind of similar case like urs and couple of queries...

          1. You need to find a job quickly or get your payroll run ASAP.
          2. As your H1 is approved, you no longer have to report to your school.
          3. N/A
          4. No need to file COS, your status will be H1 as it is already approved. Get a job at any clients place and file your amendment.

            When you apply for H1, the purpose of the application itself is to change your status to H1 from whatever you are currently on (F1, F2, H4, etc.)

              your OPT will no longer valid you could have asked USCIS to with draw your application after your H1 approved.Try to find to job ASAP or ask your employer to run payroll !

                Agree on that but application has two part like H1B petition and COS too. while filing H1B, if we have gone for H1B petition only in that case we need to do COS after approval, right? This post owner has applied for OPT as backup so I guess he/she might have filed only H1B petition.

                  H1b is for temporary employee if u r employer don't need u r service u should go back to home country or else transfer to another employer who needs a temporary employee

                  ( h1 Employment means u are working for an employer at a location specified in lca. u can be on bench but all employment conditions should be fulfilled .. )

                    1 on h1 u should be employed all the time
                    2 if u did not file cos then u will be on f1 then u have to fallow f1 rules ..to check this call sevis or talk to u r dso .
                    3 if u are on f1 then start date should be the date u started working on opt ..
                    4 check with dso or call sevis
