Hello I am a masters student who will graduate in may 2015. Due to some unavoidable reasons I had to go to India for five months and now I am back to complete my masters. I have a new visa and a neww sevis number. With only one semester to go for my degree completion with new sevis and visa I cannot apply for CPT or OPT. Hence I have found an employer willing to file H1B for me. I wanted to ask (1) When should my employer file for my H1b. (2) Can I work after may 2015 that is completing my degree even when my H1B application is pending. (3) Can I stay IN USA till my application for H1B status is pending. (4) When can I expect to get my result for H1b whether it has been given or denied.

3 u have to have valid status to stay . u may have 60 day grace period from may .. It is not enough to cover till oct 1

Try h1b with premium processing, you 'll know the result earlier and this will give to time to plan out other opting ahead of time. All the best.Comment
